This ambitious literary history traces the American novel from its emergence in the late eighteenth century to its diverse incarnations in the multi-ethnic, multi-media culture of the present day. In a set of original essays by renowned scholars from all over the world, the volume extends important critical debates and frames new ones. Offering new views of American classics, it also breaks new ground to show the role of popular genres - such as science fiction and mystery novels - in (...) the creation of the literary tradition. This essay considers the tension between political liberalism and gender equality in the light of social construction and multiculturalism. The tension is exemplified by the work of Martha Nussbaum, who tries to reconcile a belief in the universality of certain liberal values such as gender equality with a political liberal tolerance for cultural practices that violate gender equality. The essay distinguishes between first? and second?order conceptions of autonomy, and shows that political liberals mistakenly prioritise second?order autonomy. This prioritisation leads political (...) liberals to seek to limit state interference in individuals' choices. However, the essay argues that if options, choices and the preferences which lead to them are socially influenced or constructed, it is no longer clear that state non?interference secures autonomy. Instead, it becomes a matter of justice what the content of the social or state influence is, which options are open to people, and political liberalism cannot deal with many forms of injustice. Rather than emphasising state neutrality, liberals should endorse state prohibition of practices which cause significant harm to those who choose them, if they are chosen only in response to unjust norms. Past research (Lawson, 2004; Nonis & Swift, 2001) has revealed a correlation between academic and business ethics. Using a sample survey, this study extends this inquiry by examining the role of dispositional variables (neuroticism, extraversion, and conscientiousness) and academic honesty on business ethics perceptions. Results indicate that (1) neuroticism and conscientiousness were positively related to more ethical perceptions in a work context, and (2) academic honesty partially mediated the relationship between conscientiousness and business ethics. IntroductionWith a definition that is evolving, a serious component of the contract cheating issue involves individuals paying a third-party to complete assessment items for them and then submitting this work as if it were their own. The issue of contract cheating poses a significant problem for tertiary institutions. The research literature conducted to date has addressed contract cheating, yet few papers discuss theory-based prevention strategies, and even fewer still evaluate the impact of theory-based prevention strategies.Case descriptionThis paper discusses a case (...) study of contract cheating that was identified in a business simulation operating in a capstone unit at a large Australian university. The problem is outlined, the theory-based intervention is explained, and the impact on the contract cheating problem is quantified.Discussion and evaluationBuilding on a platform provided by criminological theory and crime prevention practice, the Unit Coordinator systematically adjusted a large number of assessment elements to ensure contract cheating was less likely. Importantly, this intervention was effective but also did not disadvantage students who were not engaging in contract cheating.ConclusionsOverall, this paper connects criminological theory and crime/problem prevention practice with academic misconduct issues with the intent of demonstrating there is potential to minimise the opportunity for contract cheating by altering the opportunity structures for assessment items. Crucially, this can be done without impeding genuine student efforts and does not depend on apprehension and conviction. (shrink)

Due to the prevalent influence of legal trends in driving ethical homogenization and persistent decoupling between ethical substance and symbolism in today’s organizations, scholars are calling for a renewed interest in the structural makeup of ethical codes. This article explores the disclosure trends and examines the contents of codes of ethics in the context of Canadian publicly listed acquirers. Relying on the analysis of codes’ public availability, structure, purpose, and promoted values, four clusters of behavior are identified. Although many firms (...) avoid the public disclosure of their codes, the results indicate that code of ethics’ patterns in sample firms are not driven merely by regulatory forces but increasingly shaped by aspirations for building a sustainable values-based corporation. The reported differences across clusters demonstrate that many companies in Canada overcome isomorphic pressures by displaying some originality in the writing of their codes. While symbolism in codes of ethics’ design and adoption prevails in publicly listed acquiring firms, the study provides evidence of an emerging trend of substantial commitment to social responsibilities. Objectives: Mindful parenting, measured by the Interpersonal Mindfulness in Parenting scale, is beneficial for parents and children. However, the IMP has not been validated in English-speaking parents. Further, little is known about whether mindful parenting is similar in parents of children vs. infants, or how it reduces child internalizing problems. We sought to validate the IMP in English-speaking mothers of children and infants, and to examine relationships between the facets of mindful parenting, child internalizing problems and parent variables related to (...) internalizing.Methods: Using confirmatory factor analyses, we examined the fit of various models of mindful parenting in English-speaking community-recruited mothers of children aged 3–18 years and infants aged 0–2 years. We used regression analyses to investigate relationships between the facets of mindful parenting, child internalizing problems, and parent variables including parental experiential avoidance, unhelpful beliefs about child anxiety and accommodation of child anxiety.Results: Mindful parenting can be measured in English-speaking mothers, using either a 5- or 6-factor, 29-item version of the IMP. These versions of the IMP operate similarly for mothers of children and infants. Child internalizing problems and related parent variables were best predicted by non-judgmental acceptance of parenting in mothers of children, and emotional self-awareness and non-reactivity in mothers of infants.Conclusions: The IMP is a valid measure of mindful parenting in English-speaking mothers of children and infants. Mindful parenting predicts child internalizing problems and related parent variables, suggesting that mindful parenting programs could benefit families of children with internalizing problems, potentially by reducing parental experiential avoidance, unhelpful beliefs about or accommodation of child anxiety. The environmental crisis—because of its complexity, urgency, unpredictability, and scale—requires a defence of the educational role of philosophy and an account of how to implement philosophical pedagogy in the exploration of environmental issues. This is the aim of this paper. As we face an uncertain future, all educators must consider what knowledge and “know-how” young people need, and what kind of people they need to become, if they are to survive and thrive in this changing world. Philosophical educators cannot assume (...) the ongoing utility of their practice, nor can they expect that their practice should remain the same. In the context of the current crisis, the philosophical exploration of emerging environmental issues raises challenges for those who work in the spirit of Community of Enquiry and these challenges require both discipline and flexibility from practitioners and participants. This paper outlines some of the adaptations that I have used to try and respond flexibly to this predicament. But I also defend an issue on which I believe philosophical educators should hold the line—namely the importance of being non-directive on matters that are philosophically contentious. I defend the view that despite the existential nature of this emergency and its profound urgency, it is not the role of philosophical educators to convince or coerce philosophical learners to adopt particular views on the philosophical questions that this crisis raises. This is because all philosophical enquiry involves creating an environment of freedom and responsibility with respect to what participants believe to be right and true and what they do as a result. Participants in enquiry must be epistemically free to explore and evaluate philosophical questions as they see fit, but they must also be epistemically responsible for the evidence and arguments on which their provisional judgements rest. Equally, participants in enquiry must be ethically free to respond to philosophical problems in ways that express and cultivate their authentic character and commitments, but they remain ethically responsible for their true motivations, their professed values and for the real-life consequences of their words and actions, and their silences and inaction. This paper explores some ways to optimise freedom and responsibility in all forms of philosophical enquiry, drawing specifically on examples of my work with young people on philosophically contentious environmental issues. These examples also highlight some of the adaptations that I have developed to address the challenges that environmental enquiry brings. (shrink)

The relevance of social norms for understanding appropriate behaviour in context has taken central stage in politeness research in recent years, and particularly in studies of workplace interaction. As an example of this research, this paper explores the way in which a group of nurses interacting with their colleagues negotiates complaints. The data were collected in a ward of a public healthcare institution in New Zealand and consist of audio and video recordings of four roster meetings involving nurses and nurse (...) managers. Instances of nurses’ complaints are explored from an interactional sociolinguistic point of view, allowing the researcher to investigate emergent facework. The findings suggest that multiple ingroup and outgroup memberships, achieved through the dynamic use of personal pronouns, enact preferred politic behaviour for both, transactional and relational goals. In addition, nurses’ convergence in their display of socio-pragmatic norms governing their complaining practices suggests that this group of nurses belongs to the same workplace community. Finally, strong emphasis is placed on the role that complaining plays in the positive presentation of nurses’ identities. (shrink)

In “Feminist ethics, autonomy and the politics of multiculturalism”, Sawitri Saharso argues that the feminist concern to protect women’s autonomy legitimates and permits two practices which might otherwise seem antithetical to feminism: hymen repair surgery and sex-selective abortion. Sex-selective abortion is given pragmatic support: since it is rare in the Netherlands (the focus of Saharso’s paper), and since limitations on abortion would adversely affect the autonomy of women who sought an abortion for other reasons, Saharso concludes that Dutch law ought (...) not to be changed to make such abortions more difficult. Hymen repair surgery is given much stronger support: she concludes that making it available is “both a multiculturalist action and good feminism” (Saharso, 2003: 211), thus suggesting that there need be no clash between feminism and multiculturalism. In this paper, I argue that Saharso’s argument takes inadequate account of the ways in which the practices reinforce sex inequality in the culture as a whole. As a result, her treatment of women’s autonomy gives insufficient weight to culture despite her aim to support multiculturalism. (shrink)

Many modern societies are committed to harmonizing their laws and public policies with their deeply felt moral values. To succeed in this accomplishment is to employ methods that move rationally from fundamental values to the policy incarnations that the society installs and maintains. This paper is an examination into what this method ought to be if policies are to instantiate agreed-upon fundamental moral commitments rather than the arbitrary whims of tyranny and anarchism or the political expedience of compromise.

Previous research has investigated the links between Mergers and Acquisitions (M&As) and the monetary magnitude of executive compensation, but failed to inquire how the adoption of specific attributes of compensation contacts relates to M&A activities. We address this gap in the literature by examining the impacts of some M&A characteristics and acquirers' features on the adoption of executive compensation protection provisions and new Long-Term Incentive Plans (LTIPs). The study adopts a longitudinal design before after M&A deals for 80 Canadian acquiring (...) companies that engaged in M&A activities between 1995 and 2001. Our findings suggest that both transactional and organisational characteristics significantly explain the executive compensation arrangements' adoption around M&A transactions, but that the adoption of new LTIPs is subjected to a different set of determinants than the adoption of compensation protection provisions. We interpret these results in the light of the agency, political and institutional perspectives. (shrink)

This article seeks to encounter the late ancient doctrine of creatio ex nihilo from a new angle, gently questioning both its distinctive Christianness and its inevitable alignment with a theology of absolute sovereignty. Franz Rosenzweig's idiosyncratic elaboration of this doctrine opens up new lines of thought: multiplying the “nothing” while also emphasizing its fecundity, he articulates not only a negative theology but also a negative anthropology and cosmology; insisting on the irreducible relationality of God, human, and world, he also posits (...) their non‐essentiality. Admittedly, early versions of creatio ex nihilo foreground the omnipotence of the creator and the goodness of the created world, and these concerns continue to be expressed by later proponents of the ex nihilo, Jewish as well as Christian. However, beginning in the fourth century there are hints of something new as well, something more Rosenzweigian—namely, a preoccupation with the nothing itself. What comes increasingly to the fore in these articulations of the ex nihilo is not mastery but mystery, not power but fragility, not separation but intimacy—and paradoxically so, given that the gap between creator and created has never before seemed to yawn so widely. This shift is manifest in the opening passages of Genesis Rabbah, I would suggest. It is also evident in the locus classicus of post‐Constantinian Christian ex nihilo doctrine, namely Athanasius's On the Incarnation of the Word of God. (shrink)

This paper examines the temporality of agency in Judith Butler's and Saba Mahmood's writing. I argue that Mahmood moves away from a performative understanding of agency, which focuses on relations of signification, to a corporeal understanding, which focuses on desire and sensation. Drawing on Gilles Deleuze's reading of Henri Bergson, I show how this move involves a changed model of becoming: whereas Butler imagines movement as a series of discontinuous beings, in Mahmood's case, we get an understanding of becoming.

Though there has been interest in philosophical counselling in South Africa since at least the 1990s little has been accomplished by way of formalizing and developing the practice into a profession. We ask what would be required for it to become a fully-fledged profession? We argue that in order to count as a profession, a practice must meet certain normative, cognitive, and organizational criteria, but that philosophical counselling in South Africa falls short both cognitively and organizationally. This has implications for (...) individual philosophical practitioners, it would seem, who cannot any longer consider themselves professionals. We argue that being a professional is not contingent on belonging to an established profession, but rather that to claim to be a professional is to claim that one can be trusted because one has the client’s good at heart. Exploring the idea of trust highlights again, though this time from an ethical rather than from a sociological perspective, that there is an urgent need to fill the cognitive and organizational gap that exists in South Africa. We propose that in order to facilitate the professionalization of philosophical counselling in South Africa, we should adopt an approach that focuses on the training of philosophical counsellors in the hopes that an organizational component will grow out of this rather than following previous attempts to put organizations first. This lavishly illustrated book establishes the towering influence of the scientist Victor Regnault in the earliest decades of photography, a period of experimentation ripe with artistic, commercial, and scientific possibility. Regnault has a double significance to the early history of photography, as the first leader of the Société Française de Photographie and as the maker of more than two hundred calotype portraits and landscapes. His photographic and scientific careers intersected a third field with his appointment in 1852 as director of (...) the Sèvres porcelain works. Readers are treated to Regnault's own beguiling pastoral, garden, and forest scenes; striking portraits of the scientists and artists in his circle of friends; quirky images of acoustic experiments; and an insider's view of the Sèvres porcelain works. Regnault's richly varied photographs also encompass perhaps the most extensive group of family portraits in early photography, and his romanticized landscapes reflect a moment when the rural outskirts of Paris were being aggressively suburbanized and industrialized. Occupying a unique and powerful position in the overlapping spheres of photography, science, industry, and art, Regnault was elected president of the newly formed S.F.P. in 1855. By examining his intertwined activities against the backdrop of French photography's nascent pursuit of institutional legitimacy, this book illuminates an important and overlooked body of images and the irregular cultural terrain of early photography. This paper begins by reflecting on the concept of habit and discussing its significance in various philosophical and non-philosophical contexts – for this helps to clarify the connections between habit and selfhood. I then attempt to sketch an account of the self as ”nothing but habit,“ and to address the questions this raises about how such a self must be constituted. Finally, I focus on the issue of freedom, or liberation, and consider the possibility of moving beyond habit. I emphasize (...) the body since it is through the body that the un-doing of habit must take place. Deleuze and Merleau-Ponty are distinguished from the many philosophers who have recognized the importance of habit by their more radical claim that we not only have habits, but are habits – and for this reason I draw on their work in the first two sections of this paper. The main purpose of this article is to elucidate the bright connotation of the self-conscious emotion of pride, namely authentic pride, in the broader context of behavioral governance literature. Scholars in the field of psychology suggest that authentic and hubristic pride represent two facets of the same emotional construct. Yet, our review indicates that in the extant governance research pride has been treated as an exclusively dark leadership trait or self-attribution bias, thereby placing hubris among the main causes of managerial (...) failure. After conceptually differentiating the two aspects of pride, we identify and discuss the myriad of positive governance implications stemming from firm members' tendency toward authentic pride. We argue that the examination of both positive and negative facets of pride constitutes a critical complement to the existing governance landscape largely dominated by economic theories and formal mechanisms of control. This article allows practitioners to better understand the emotional processes involved in governance that are needed to predict the workplace effectiveness of employees, identify individuals prone to experience authentic pride in the early stages of the recruitment process, and design specific interventions for acting upon and putting emotional energy into productive use.
